A victory for Look-Hear

Look-Hear was surprised in 1999 when another London media company, Oscar Music and Media Ltd,  registered the domain name www.lookhear.com - the LOOK-HEAR name but without the hyphen.  We considered it  strange for another media company to register a domain name almost identical to ours, especially as we own the registered trademark "Look Hear".  We went to arbitration to try and have the unused domain transferred to us.  The rules of arbitration at that time meant that to win, we had to prove that Oscar Music and Media had heard of us before they registered their domain.  That proved an impossible task and so we lost the case.  But it didn't matter.  We already have www.look-hear.com - we don't need another website address.  Most crucially, ever since the case, Oscar Music and Media Ltd. has been on notice by our trademark attorneys that if they ever made use of their domain, www.lookhear.com,  for their media or music activities, we would consider High Court action against them for trademark infringement.  Their site has remained blank ever since.  A victory for LOOK-HEAR.

Using the WIPO "Domain Name Dispute Resolution Service" cost us around £1,000.  It was money well spent.  The media interest generated in favour of Look-Hear's case was estimated to be worth over £100,000.

Controversial BBC Broadcast about LOOK-HEAR versus LOOKHEAR

Click to go to the website of the BBC Three Counties Radio Consumer Programme which featured Look-HearThe Stephen Rhodes Consumer Programme on BBC Three Counties Radio ran a programme about the LOOK-HEAR battle against the other  London media company who registered the domain www.lookhear.com.  The BBC presenter, Stephen Rhodes, supported the view that a hyphen in one name made it different to the other.  Mr Rhodes appeared to ignore trademark law and precedents stipulating that a hyphen in a name makes no difference at all.  LOOK-HEAR had asked the BBC to have an independent trademark lawyer on the programme to make the position clear...but they refused.

'What's in a hyphen?'

Following the BBC broadcast, Jon Danzig put it to the BBC that if they  considered that a hyphen - or lack of one - made all the difference to a name, then they should not object to LOOK-HEAR registering www.BBC-Three-Counties-Radio.com.   The Observer newspaper wrote a small piece about the BBC's response to this - click to read.
